Melvin Leon Guerrero, Jr., 25, faces rape charges involving two female minors, who live in the same house as he.
Prosecutor Sean Brown today in Superior Court brought charges containing several counts of first degree rape, attempted first degree rape, and second- and third degree criminal sexual conduct against Mr. Leon Guerrero.
Mr. Brown's declaration of probable cause against Leon Guerrero contains the following narrative:
"On or about April 22, 2021, police responded to a complaint at the Dededo Precinct. Police met with a witness who explained that two female minors known to her as J.L.I., 13, and A.K.L.G, 14, were 'touched' by her cousin MELVIN SABLAN LEON GUERRERO JR. (Defendant). The witness informed police that Defendant is a household or family member to both A.K.L.G and J.L.I. The witness told police that Defendant was holding J.L.I. down and 'trying to sexually assault her' and that Defendant did have 'sex' with A.K.L.G at the same residence.
"Police interviewed J.L.I. who said she was spending the night at A.K.L.G.'s house on March 22, 2021 when she was woken up at about 4:00 am to discover Defendant laying on top of her. J.L.I. told police that Defendant had one of his legs between her legs and one hand on the floor next to her rib cage. J.L.I. explained that she told Defendant to stop and he said to lower her voice. J.L.I. said that she heard Defendant say 'just let me do it.' J.L.I. stated to police that this was going on for about ten minutes before she was finally able to fight him off by using her arm and knee to push him off. J.L.I. informed police that Defendant asked her not to tell anyone and only left after J.L.I. promised she would not tell anyone.
"Police interviewed A.K.L.G. who explained that in December of 2020, Defendant was on top of her while she was sleeping. A.K.L.G. stated that Defendant put his penis into her vagina while she was trying to get out from under him. A.K.L.G. told police that Defendant was sexually assaulting her from age 12 to 14. J.L.I, told police that A.K.L.G. said to her that there were about two other times where the same thing happened in January and March of 2021. A.K.L.G. told police that during the different times, Defendant would pin her down, lay directly on her or pick her up and drag her."
Leon Guerrero denied the allegations.
